In a memo to President Obama, former National Security Agency insiders William Binney, Thomas Drake, Edward Loomis and J. Kirk Wiebe explain how NSA leaders botched intelligence collection and analysis before 9/11, covered up the mistakes, and violated the constitutional rights of the American people, all while wasting billions of dollars and misleading the public.

MEMORANDUM FOR: The President

FROM: Former NSA Senior Executives/Veteran Intelligence Professionals for Sanity (VIPS)

SUBJECT: Input for Your Decisions on NSA

EXECUTIVE SUMMARY

Official Washington – from Senate Intelligence Committee chair Dianne Feinstein to NSA Director Keith Alexander to former Vice President Dick Cheney to former FBI Director Robert Mueller – has been speaking from the same set of NSA talking points acquired recently via a Freedom of Information request. It is an artful list, much of it designed to mislead. Take this one, for example:

– NSA AND ITS PARTNERS MUST MAKE SURE WE CONNECT THE DOTS SO THAT THE NATION IS NEVER ATTACKED AGAIN LIKE I WAS ON 9/11

At a hearing of the Senate Judiciary Committee on October 2, Senator Feinstein showed her hand when she said: “I will do everything I can to prevent this [NSA’s bulk] program from being canceled.” Declaring that 9/11 “can never be allowed to happen in the United States of America again,” Feinstein claimed that intelligence officials did not have enough information to prevent the terrorist attacks.

Mr. President, we trust you are aware that the lack-of-enough-intelligence argument is dead wrong. Feinstein’s next dubious premise – that bulk collection is needed to prevent another 9/11 – is unproven and highly unlikely (not to mention its implications for the privacy protections of the Fourth Amendment).

Given the closed circle surrounding you, we are allowing for the possibility that the smell from these rotting red herrings has not yet reached you – even though your own Review Group has found, for example, that NSA’s bulk collection has thwarted exactly zero terrorist plots.

The sadder reality, Mr. President, is that NSA itself had enough information to prevent 9/11, but chose to sit on it rather than share it with the FBI or CIA. We know; we were there. We were witness to the many bureaucratic indignities that made NSA at least as culpable for pre-9/11 failures as are other U.S. intelligence agencies.

We prepared this Memorandum in an effort to ensure that you have a fuller picture as you grapple with what to do about NSA. What follows is just the tip of an iceberg of essential background information – much of it hidden until now – that goes to the core of serious issues now front and center.

The drafting process sparked lively discussion of the relative merits of your Review Group’s recommendations. We have developed very specific comments on those recommendations. We look forward to an opportunity to bring them to your attention.

Introduction

We write you with a sense of urgency looking toward your upcoming decisions regarding the activities of the National Security Agency. We the undersigned (William Binney, Thomas Drake, Edward Loomis, and Kirk Wiebe) worked with NSA for a total of 144 years, most of them at senior levels. Our mission required the highest technical skills to keep the country safe from foreign enemies, while protecting the privacy rights of U.S. citizens under the Fourth Amendment to the U.S. Constitution.

For us, the 21st Century arrived with serious management and technical shortcomings at NSA in meeting the huge challenges posed by the digital and Internet age and the huge problems accompanying the transition from a Cold War footing over 40 years to an increasingly complex world with many asymmetric threats.

NSA management’s reaction in this environment not only opened the door to the attacks of 9/11 but led to violation of what had been the “First Commandment” at NSA; namely, “Thou Shalt Not Eavesdrop on Americans Without a Court Warrant.” Under the circumstances, three of us (Binney, Loomis, and Wiebe) left; Drake had just come on board in hopes of playing a constructive role in addressing the challenges at NSA.

We all share an acute sense of regret for NSA’s demonstrable culpability for what happened on 9/11, and – for those of us working there before the terrorist attacks – a remorse for not having been able to stop them. We tried; but it is hard to escape a nagging regret that, somehow, we should have tried harder.

We were there; we know what happened. And we know how what happened has been successfully covered up – until now. Calamities like this tend to happen again if there is no accountability for what happened before. You need the unvarnished truth. The flood of revelations now in the public domain frees us to address facts and events formerly hidden behind a convenient, cover-up classification regime. We feel bound by the solemn oath we took to support and defend the Constitution of the United States against all enemies, foreign and domestic, to make truths known to you that you may find as unconscionable as we do.

Why do we still care? Because we have consciences; because the oath we took has no expiration date; because we know – as few others do – how critically important it is for our country to have a well functioning, Constitution-abiding National Security Agency; and because we know how that ship can be steered back on course at that important place of work by improving its ability to find terrorists and other criminals in massive amounts of data, while protecting the right to privacy and citizen sovereignty.

Getting in the Door

It comes to us as no surprise that there is strong resistance on the part of the Establishment when it comes to giving us a hearing – a shunning of the very people who know what happened and how to take steps to prevent it from happening again.

Our predicament calls to mind that of our colleague veteran intelligence professionals, who were ignored by Official Washington and an obsequious media, when we knew that fraudulent (not mistaken) intelligence was being used to “justify” the launching of an aggressive war on Iraq 11 years ago. Establishment Washington barred the doors in 2002-2003. Just five years later our own clearances were taken away.

Now, once again the voices of seasoned intelligence professionals are being muted, in favor of a closed group of officials with huge incentive to cover up their failure to keep America safe and their playing fast and loose with the Fourth Amendment.

Mr. President, we have given up hope that your palace guard will let us in. Our chances of reaching you seem far better via this Memorandum, the 28th of its kind issued since early 2003, prepared at the behest of the Steering Group of our Veteran Intelligence Professionals for Sanity (VIPS). If this gets past your in-box protectors, we encourage you to pay more heed to it than your predecessor did to VIPS’ warnings in the months before the attack on Iraq.

In one limited sense, we are better off than our colleagues 11 years ago. This time, mainstream media have been unable to ignore the documentary evidence of rank dishonesty on the part of senior NSA and other intelligence officials. This time the media has come to us, seeking our views. This time we can comment rather freely on matters that until now were hidden under TOP SECRET stamps.

On December 26, for example, The Wall Street Journal published a lengthy front-page article, quoting NSA’s former Senior Technical Director William Binney (undersigned) and former chief of NSA’s SIGINT Automation Research Center Edward Loomis (undersigned) warning that NSA is drowning in useless data lacking adequate privacy provisions, to the point where it cannot conduct effective terrorist-related surveillance and analysis.

A recently disclosed internal NSA briefing document corroborates the drowning, with the embarrassing admission, in bureaucratize, that NSA collection has been “outpacing” NSA’s ability to ingest, process, and store data – let alone analyze the take.

54 Now Down to Zero ‘Thwarts’

It is not difficult to connect NSA’s collect-everything approach with one principal finding of the Review Group you appointed to look into NSA programs; namely, that exactly zero terrorist plots have been prevented by NSA’s bulk trawling for telephone call records. One Review Group member, your former Chicago law professor colleague, Geoffrey Stone, has confessed to being “absolutely” surprised at the group’s finding of zero. Clearly, the statements of top NSA officials left Stone wholly unprepared for the truth. More

Clinton's $33m raid on Pakistan shows that, in the end, hypocrisy will win

La Clinton hath spoken. Thirty-three million smackers lopped off Pakistan's aid budget because its spooks banged up poor old Dr Shakeel Afridi for 33 years after a secret trial. And, as the world knows, Dr Afridi's crime was to confirm the presence of that old has-been Osama bin Laden in his grotty Abbottabad villa.

Well, that will teach the Pakistanis to mess around with a brave doctor who is prepared to help the American institution that tortures and murders its enemies. Forget the CIA's black prisons and rendition and water-boarding, and the torture of the innocents in the jails of our friendly dictators. Dr Afridi was just doing the free world a favour. And WOW, Dr Afridi got shopped by Leon Pannetta when he was CIA boss, and now Barack Obama is accused of letting him down.

Well, I pause here. Dr Afridi was brought before a secret trial in the Khyber tribal area – no charge sheets, no lawyers, no statements from the defendant or the prosecution, just a measly accusation of conspiracy against the state of Pakistan and "high treason". I've never known the difference between "treason" and "high treason" but – since Pakistan's security apparatus is a mirror image of the British Empire – I assume it was invented by us. "High treason" means treason against the monarch. By fingering Bin Laden, after using a ruse about vaccinating his family against hepatitis B to gain access to him, Dr Afridi was committing treason against King Asif Ali Zardari, otherwise known as the President of Pakistan.

But hold on a moment. Let's suppose Vladimir Putin sent a KGB/FSB hit squad to Britain to murder a former agent called Alexander Litvinenko who had turned against his old spymasters. And let's suppose that the Russians murdered Litvinenko. Which – in real life – they did. And Litvinenko – in real life – was indeed a trusted agent of the Russians, just as Bin Laden was a much-admired servant of the CIA when he was fighting the Russians in Afghanistan.

Getting a bit close to home? Well, let's go a stage further. Supposing Litvinenko was murdered after being identified by a friendly British GP – working for the KGB/FSB – who vaccinated the Litvinenko family against hep B. What do Messrs Cameron and Clegg and the Commissioner of the Metropolitan Police and the Lord Chief Justice and the Lord High Executioner and all the other nabobs do? Do they accuse the British GP of treason, clap him in irons, stage a hush-hush trial covered by the Official Secrets Act and send the chap off to rot in the Tower of London for – say – 33 years?

Or do they accept a bribe from Moscow of, say, $33m (£21m) to let the GP out of jug so he can potter off to Moscow to be given a new home and restart his career as a doktor for the nomenklatura?

In other words, are the Pakistanis being so dastardly when they lock up a national who has helped a foreign power murder an exile inside his own country of Pakistan? And, more to the point, wouldn't we do the same?

And let's take the story of hypocrisy a stage further. Wasn't there a brave Israeli citizen called Mordechai Vanunu, who, in opposition to the nuclear weapons that his country was amassing in secret, spoke out to the world about this outrageous threat to international world order and was subsequently kidnapped from Italy by intelligence agents, tried in Israel for "treason" – in secret, of course – and spent 18 years in prison? Now I grant you that's 15 years shorter than poor old Dr Afridi, but Vanunu still lives under grave restrictions to his liberty and has twice been imprisoned again for the heinous crime of chatting to foreign journalists.

And has La Clinton threatened to suspend a single dollar of Israel's annual $3bn in aid from the United States for the next 33 years in order to protest Israel's treatment of Vanunu? Not to mention – not even to utter the words – Sabra and Chatila, Gaza, a 45-year occupation, illegal colonisation of West Bank land, etc, etc, or, indeed, for producing nuclear weapons. And we absolutely must not mention Jonathan Pollard, the former CIA and US Navy intelligence officer sentenced to life in prison in 1987 for spying for Israel. For if Pollard is not released, is Israel threatening to cut its aid to America? Hold on, that doesn't quite compute, does it? But you get the point. More

Al-Qa'ida Cashes In 'If you feed a scorpion, it will bite you'

September 17, 2012 "The Independent" -- A Damascus friend of mine called this weekend and was pretty chipper. "You know, we're all sorry about Christopher Stevens. This kind of thing is terrible and he was a good friend to Syria – he understood the Arabs." I let him get away with this, though I knew what was coming. "But we have an expression in Syria: 'If you feed a scorpion, it will bite you'." His message couldn't have been clearer.


Libya
The United States supported the opposition against Libya's Colonel Gaddafi, helped Saudi Arabia and Qatar pour cash and weapons to the militias and had now reaped the whirlwind. America's Libyan "friends" had turned against them, murdered US ambassador Stevens and his colleagues in Benghazi and started an al-Qa'ida-led anti-American protest movement that had consumed the Muslim world.

The US had fed the al-Qa'ida scorpion and now it had bitten America. And so Washington now supports the opposition against Syrian President Bashar al-Assad, was helping Saudi Arabia and Qatar pour cash and weapons to the militias (including Salafists and al-Qa'ida) and would, inevitably, be bitten by the same "scorpion" if Assad was overthrown.

My friend's sermon was not quite in line with Syrian government policy. Assad's argument is that Syria is not Libya, and that Syrians, with their history, culture, love of Arabism, etc, did not want a revolution. But the Arab fury at Hollywood's obscene little anti-prophet video has occasioned almost as much rewriting of history in the West.

The US media has already invented a new story in which America supported the Arab Spring saved the city of Benghazi when its people were about to be destroyed by Gaddafi's monstrous thugs – and has now been stabbed in the back by those treacherous Arabs in the very city rescued by the US.

The real narrative, however, is different. Washington propped up and armed Arab dictatorships for decades, Saddam being one of our favourites. We loved Mubarak of Egypt, we adored Ben Ali of Tunisia, we are still passionately in love with the autocratic Gulf states, the gas stations now bankrolling the revolutions we choose to support – and we did, for at least two decades, smile upon Hafez al-Assad; even, briefly, his son Bashar.

So we saved Benghazi with our air power and expected the Arab world to love us. We ignored the composition of the Libyan militias we supported – just as Clinton and Hague don't dwell on the make-up of the Free Syrian Army today. We pay no attention to Assad's warnings of "foreign fighters", just as we largely ignored the Salafists who were moving among the brave men who fought Gaddafi.

Go back further, and we did pretty much the same in Afghanistan after 1980. We backed the mujahedin against the Soviets without paying attention to their theology and we used Pakistan to funnel weapons to these men. And when some of them transmogrified into the Taliban and nurtured Osama bin Laden and the scorpion bit on 9/11, we cried "terrorism" and wondered why the Afghans "betrayed" us. Race to the End

ISLAMABAD — One of the more tenacious conspiracy theories that have taken root in the hothouse of Pakistan's capital is that Osama bin Laden was not killed in the May 2, 2011, Navy SEAL raid on his compound in Abbottabad -- that, in fact, he had already been dead for years, killed in the caves of Tora Bora.

According to this theory, the CIA had been keeping bin Laden's corpse on ice, literally, ready to be resurrected at a moment when his "death" could better serve U.S. interests. That moment came when the SEALs decided to conduct a dry run of their long-planned operation to snatch Pakistan's nuclear weapons. Bin Laden's thawing corpse was brought along as cover in case the exercise blew up -- and as a devious bit of political theater to besmirch Pakistan's reputation if all went well.

What keep conspiracy theories like this alive are bits and pieces of half-baked evidence that could be construed to support a deeply held belief. In this case, it is the belief -- accepted across the board in Pakistan, from the top brass of its military down to the dusty gaggle of taxi drivers who awaited me each morning outside my Islamabad hotel -- that the United States has a not-so-secret plan to snatch Pakistan's nuclear arsenal.

"With 70 to 80 kilos of highly enriched uranium, it would be fairly easy to make one in the basement of a building in the city of your choice," said Pervez Hoodbhoy, a distinguished nuclear physicist at Islamabad's Quaid-i-Azam University.

The United States, which is duly concerned that Pakistan's nukes could fall into the wrong hands, almost certainly does have a plan to neutralize those weapons in the event of a coup or total state collapse. When the question was put to Condoleezza Rice during her 2005 confirmation hearings to become secretary of state, she replied, "We have noted this problem, and we are prepared to try to deal with it."

"Try" is the key word. Military experts -- American, Pakistani, and Indian -- agree that grabbing or disarming all of Pakistan's nukes at this stage would be something close to mission impossible. As one senior Pakistani general told me, "We look at the stories in the U.S. media about taking away our nuclear weapons and this definitely concerns us, so countermeasures have been developed accordingly." Such steps have included building more warheads and spreading them out over a larger number of heavily guarded locations. This, of course, also makes the logistics of securing them against theft by homegrown terrorists that much more complicated.

Fears of that terrifying possibility were heightened in August, when a group of militants assaulted a Pakistani base that some believe houses nuclear weapons components. Nine militants and one soldier were killed in a two-hour firefight at the Kamra air force base. The local media immediately floated the theory that this, too, was part of the American plot to steal Pakistan's nukes. But more disturbing than any conspiracy theory is the reality that this was the fourth attack in five years on the Kamra base, just 20 miles from the capital. Seals reveal Truth about Ben Laden Raid

Osama Bin Laden was killed within 90 seconds of the US Navy Seals landing in his compound and not after a protracted gun battle, according to the first account by the men who carried out the raid.

The operation was so clinical that only 12 bullets were fired.

The Seals have spoken out because they were angered at the version given by politicians, which they see as portraying them as cold-blooded murderers on a kill mission. They were also shocked that President Barack 0bama announced Bin Laden's death on television the same evening, rendering useless much of the intelligence they had seized.

Chuck Pfarrer, a former commander of Seal Team 6, which conducted the operation, has interviewed many of those who took part for a book, Seal Target Geronimo, to be published in the US this week.

The Seals own accounts differ from the White House version, which gave the impression that Bin Laden was killed at the end of the operation rather than in its opening seconds. Pfarrer insists Bin Laden would have been captured had he surrendered.

There isn't a politician in the world who could resist trying to take credit for getting Bin Laden but it devalued the intelligence and gave time for every other Al-Qaeda leader to scurry to another bolthole, said Pfarrer. The men who did this and their valorous act deserve better.

It's a pretty shabby way to treat these guys. The first hint of the mission came in January last year when the team's commanding officer was called to a meeting at the headquarters of joint special operations command. The meeting was held in a soundproof bunker three stories below ground with his boss, Admiral William McRaven, and a CIA officer.

They told him a walled compound in Pakistan had been under surveillance for a couple of weeks. They were certain a high-value individual was inside and needed a plan to present to the president. It had to be someone important. So is this Bert or Ernie? he asked.

The Seals nicknames for Bin Laden and his deputy Ayman al-Zawahiri are a reference to two Muppets in Sesame Street, one tall and thin and the other short and fat. We have a voice print, said the CIA officer, and were 60% or 70% certain it's our guy. McRaven added that a reconnaissance satellite had measured the targets shadow. Over 6ft tall.

When McRaven added they would use Ghost Hawk helicopters, the team leader had no doubt. These are the most classified, sophisticated stealth helicopters ever developed, said Pfarrer. They are kept in locked hangars and fly so quiet we call it whisper mode.

Over the next couple of months a plan was hatched. A mock-up of the compound was built at Tall Pines, an army facility in a national forest somewhere in the eastern US.

Four reconnaissance satellites were placed in orbit over the compound, sending back video and communications intercepts. A tall figure seen walking up and down was named the Pacer.

Obama gave the go-ahead and Seal Team 6, known as the Jedi, was deployed to Afghanistan. The White House cancelled plans to provide air cover using jet fighters, fearing this might endanger relations with Pakistan.

Sending in the Ghost Hawks without air cover was considered too risky so the Seals had to use older Stealth Hawks. A Prowler electronic warfare aircraft from the carrier USS Carl Vinson was used to jam Pakistan's radar and create decoy targets. More
